The Influence of Technology in Contracts: Cuban Legal frame

Abstract


Informatic age had fallen into a commerce development in a world scale. Cuba has seen in the e-commerce a mean to make strong its commerce, that is why this reach is part of the polemic in determine if Cuban legal regulation in a real contractual headquarter, gives covering in order to adjust the moment of perfection of contracts ending by electronics means. The plan of judicial- decree about “General rules to he practice of electronic commerce”, refer to the traditional regulating in all relative affairs to the perfection of contracts, it results contradictories that Civil Code is remiss in some of institutions of this phase. To solve this problem, it is necessary to make a doctrinal, jurisprudential and legal extensive analysis, make in conclusion if we are not facing new types of contracts, it results necessary to adjust the actual legal system and the one forming.
