The administrative penalty and its difference with other measures that impose burdens on those administered in the Spanish context

Abstract

Beyond any doubts the administrative sanction is one of the most relevant institutions in the area of sanctioning Administrative Law. The Administration has the tool to sanction its administrates as long as their behaviour is described under an administrative violation. Even though this administrative figure does not present great inconveniences at first sight, things complicate when they are assumed by other institutions generating sanctions for their associates. Therefore, the importance of the clearness of the elements conforming the notion of administrative sanction and its necessary requirement: the repressive character, which becomes the foundation of this concept.
