The institutional role of the Constitutional Court

Abstract

The Constitutional Jurisprudence about fundamental
social rights, most of which carry with them economical
interests, is an example of culture transformation not
only political but legal and its sensibilization regarding
the basic needsand the politic priority of seriously taking
the
effective acknowledgmentof people’s rights.
On the
other hand, the constitutional jurisprudence has been
designing and putting into practice a mothern conception
of the Statein wich the compliance of the State’s social
duties occupies a central place in the reorganization of the
public institutions. Nevertheless, such a drastic change
unavoidably brings along incongruities and deferements
in the jusrisprudential politics of the Court.
