The de facto marital unions between same-sex couples, an unfinished struggle against discrimination

Abstract

Based on the field research study conducted throughout Notary’s offices
in Bogotá on the due enforcement of Judgment C-075-07, summoned by
the Constitutional Court, allowing solemn declarations of homosexual de
facto marital consortiums, it is possible to state that, in spite of the broad
margin of application of its rulings, several offices exercise policies of symbolic violence and discrimination by rejecting registration requests from
homosexual couples that try to produce the aforementioned declarations.
This situation confirms that de facto marital consortiums are far from being able to construct spaces where discrimination against sexual diversity
can be controlled.
