Legal regime of the capacity of persons with disabilities of legal age in Colombia

Abstract

In Colombia, Law 1996 of 2019 established the regime for the exercise of legal capacity of persons with disabilities of legal age, thus materializing Article 12 of the Convention on the Rights of Persons with Disabilities. These norms generate a paradigm shift in the legal institution of capacity; for this reason, this article highlights the generalities of the development of the legal regime of the capacity of persons with disabilities of legal age and the challenges that it represents for Colombian law. To this end, the issue of disability in Colombia will be addressed from the 1991 Constitution, followed by an allusion to the Convention on the Rights of Persons with Disabilities, specifically in Article 12, and in the final chapter, the characteristics of Law 1996 of 2019, which harmonizes the criteria of the aforementioned Convention to Colombian law, will be explained.
