This article analyzes the treatment given by The Council of State of Colombia to the exclusive fault of the victim as grounds for exoneration of liability in direct reparation proceedings for unjust deprivation of liberty in recent years.
The research, conducted by the group CONCIENCIA JURÍDICA through the seedbed RATIO IURIS, aims to answer the question: what has been the treatment given by The Council of State of Colombia to the exclusive fault of the victim in the processes of direct reparation for unjust deprivation of liberty in recent years.
This, through a quantitative-descriptive methodology that included the description, registration, quantification, analysis, and interpretation of the acquittals related to liability for unjust deprivation of liberty, in recent years; finally, it was identified in which of these judgments the exoneration ground called exclusive fault of the victim was used.
