The model law on international commercial arbitration of UNCITRAL and its impact on the Venezuelan legal system

Abstract


This article must like objectives present some commentaries on the international commercial arbitration, summarize the general aspects of a law model, specially the Model Law on International Commercial Arbitration of the United Nations Commission on International Trade Law (UNCITRAL), and analyze its influence in the Law of Arbitration Commercial (LAC) of Venezuela. The investigation is descriptive, the documentary observation in primary and secondary sources is applied. One concludes that the
LAC
partially welcomes the postulates of theLMACI. The
LAC
is applied to the international arbitration, showing their monist character, takes care of kompetez-kompetez, the free determination of the place of the arbitration in the beginning and language, the separation of the arbitration body, the invalidity as only resource against I render, the recognition and execution of foreign lauds. To difference of the
LMACI, it regulates the institutional arbitration and the measures you will prevent are decreed once constituted the by arbitration court.
