The nature of things and the influence of the philosophy of legal experience in the work of Alessandro Baratta: An analytical review of his early writings

Abstract

In this article we present the results of the analytical review of the early writings of Baratta, specifically those related to the nature of fact, in which proposes overcoming neo-kantian and ontological presuppositions from the philosophy of legal experience. On reviewing this first group of writings, our interest is to identify the influence of the philosophy of the legal experience in the work of Baratta and his attempt to overcome the limits of this philosophy. An analytical review of his early writings on philosophy of law function as theoretical material, whose knowledge allows us, for example, to develop interpretations about the thought of Baratta more appropriate for the reconstruction of its description of the dialectic movement of reality, which in turn, feeds into the discussions of the theoretical logic in philosophy and sociology of law.
