Powers of the arbitrators against the adoption of injunction measures: A motif of tension in national arbitration

Abstract

According to the Colombian Constitution and Law, arbitrators can administer justice. The discussion is set towards the possibility to impose injunction measures by arbitrators during the exercise of their functions or wether that power is limited. In this document tensions that arise in relation to national arbitration in Colombia regarding the power of arbitrators to order injunctions will be described and analyzed. In order to accomplish this several legal provisions, prevailing doctrine and also other arguments in favor or against the acceptance of arbitrators ordering will be analyzed.
