Las competencias y el control en un Estado constitucional de derecho
Abstract
The legal competence and the control mechanisms that can be activated to limit the power of the authorities involved in amparos that protect human rights for the mexican jurisdiction are described. It starts with the amparo trial and finishes with the execution of the court ruling, including the role of international instances. It is proposed that the control enabled by the courts are inter-organic as well as supra-organic. It is considered so because it is important to take into account who promotes the control and not only who executes it. From that perspective, the description of the process of control is more inclusive. Finally, the problems that arise in the implementation of policies derived from amparos are described.
