The private restructuring agreement in the Law of Argentina: The effects of judicial validation

Abstract

This article describes and analyses the effects that produces the judicial validation of private restructuring agreement in the Insolvency Law of Argentina. It presents the approximation between the effects of private restructuring agreement and the effects of reorganization since bankruptcy reform in 2002. It also calls to attention because that approximation between the effects of both institutes can affect the rights of creditors in the private restructuring agreement. It shows how the debtor can get the same effects through private restructuring agreement as well as through reorganization but with a more flexible system. Finally, it presents our conclusions
