Abstract
The general objective is determine the
material element
of decrees with force of law themselves in Venezuela’s Bolivariana Republic Constitution of 1999. The documentary investigation strategy is
used, based on analytical method. The sources for information gathering conform to: constitutional, legal, doctrinal and jurisprudential requirements. The decrees with force of law themselves, contemplated in Venezuela’s Bolivariana Republic Constitution of 1999, constitute legal acts of normative content and general effects, with legal rank, dictated by Republic´s President in Cabinet, whose material element includes two concurrent subelements: absence of expresses material limits in Venezuela’s
Bolivariana Republic Constitution of 1999 and submissive directives, intentions and frame in national’s competition matters established in habilitate law. Venezuela’s Bolivariana Republic Constitution of 1999 allows to infer presence of tacit material limits. Each habilitate law, sanctioned by National Assembly,
forms the only express material limit of decrees with force of law themselves by its authorized.
