Challenges and Risks of the Interference of International Law in the Definition of the Concept of Sexual Violence in Colombia

The main objective of this article is to identify the implications that arise in the Colombian legal system from the incorporation of concepts from international legal systems, especially those of the International Criminal Court, in relation to violent sexual crimes. This incorporation raises questions about their adequacy and adaptation to the local context, given the existence of notable differences between the parameters that guide the administration of criminal justice at the national and international levels. To address this issue, a methodology based on a detailed analysis of the jurisprudence of the Supreme Court of Justice of Colombia was used.
The focus is on decisions that define the concept of violence in relation to crimes affecting legal rights linked to sexuality. Through this approach, the study seeks to understand how these international legal interpretations impact and modify the Colombian criminal landscape, particularly in the categorization of certain sexual acts as violent, which could alter the proportionality of sentences and the nature of the sanctions imposed.
